Refund policy
1. Payment
a. Payment Method – Payment could be made at checkout either by paying the full amount of the package or a 30% of deposit. After the 30%
deposit received, the remaining 70% payment can be made by EFT to the company’s account as shown on the company invoice
b. Credit Card payment could be arranged and would be charged 1.8% surcharge on all major credit cards and 2.9% surcharge on AMEX
c. The Customer must pay to U-Select Memorials (“THE COMPANY”) progressive payments as specified in the Payment Details section of this
contract and otherwise as when requested during construction of the work. The Customer agrees that if it fails to pay in accordance with this
clause, THE COMPANY may (without limiting any of its rights under any law):
i. Charge a late payment fee of 5% on all amounts paid after the due date;
ii. Charge interest on debts at 13.5% per annum from time to time;
iii. Charge a dishonour handling fee in the amount of $95.00;
iv. Recover all collection costs and expenses incurred in collecting overdue accounts on an indemnity basis;
v. Withhold supply; and/or
vi. Sue for the money owing on the goods or services provided.
d. In the event where this contract has been entered into by more than one party each party shall be jointly and severely liable for any amounts
overdue.
2. All title in any goods supplied remains the property of Global Memorial Pty Ltd (“THE COMPANY”) and/or U-Select Memorials (“U-Select) until
such time as the total cost of work has been paid in full by the said customer (“Customer”).
3. Guarantee
a. All parts of granite monument structure are guaranteed to be inspected and passed quality control for free of colour and pattern defects, chips,
cracks and other damages on the noticeable surfaces. The guarantee cover any major discolouring of granite surfaces and any major destructure
of the monument as deemed defect by the cemetery trust for 7 years from the completion of the monument.
b. Accessories including but not limited to granite vases, incense vases, candle holders, books and marble statues provided by the company are
guaranteed for free of defects for 2 years.
c. Other accessories including but not limited to stainless steel door(s), bronze products (including plaques), glass products and only purchased on
behalf of the customer by the company and will not be covered under this guarantee, please refer to the original supplier for their guarantee
policy.
d. If any dispute on quality of product found upon completion, Customer can lodge a written claim to THE COMPANY within 14 days of the
completion date.
e. If natural cracks and/or defect of workmanship have occurred during the warranty period, Customer can lodge a written claim to THE
COMPANY and an investigation will be conducted, if the defect is deemed to be under the cover of this guarantee, THE COMPANY will take
full responsibility and rectify the defect.
f. THE COMPANY will rectify any defect(s) covered under this guarantee in the best possible way, however replacement of defected part(s) will
not be made unless it is agreed between the customer and THE COMPANY.
g. This guarantee only covers the general structure and material used for the monument, damages caused by third parties, surrounding animals
and/or natural disaster are not covered under this guarantee.
h. All account must be cleared by the Customer before a claim of guarantee can be lodged. THE COMPANY will not be liable to any Customer
with payment outstanding.
4. Contract Price – the price quoted by the company are based on the information given by the cemetery and/or the related party, together with any
foreseeable condition at the time of the contract signed, the company will not be responsible for any change of unforeseeable condition, including but
not limited to change of cemeteries regulation or policy, change of accessibility to the working site, unforeseeable condition caused by natural
disaster, human error and change of surrounding condition, in event of such condition occur, customer may incur further cost necessary in order to
complete the job.
5. Completion timeframe
a. the company will place the order for products necessary to complete the job upon receiving the agreed initial deposit, customer will generally
expected to have the first inspection of products 6 to 13weeks after paying the initial deposit. Upon the agreement on final artwork, the company
will install the product in the agreed location within 2 to 6weeks.
b. Special date of completion (not applied to weekend and public holiday) must be notify by the customer as a special condition of the contract, the
company will not guarantee that a special date of completion can be secure if it is not specify in the contract.
c. It is the customer’s responsibility to inform the company when the completion date will be more than six months apart from the time of the
contract were made. As the company will only keep the job for any particular customer during the normal stock turnover period, any delay on
completion due to customer’s preference which is not specify when the contract made will incur a storage and handling fees equivalent to 5% per
annum of the total contract value calculating per calendar month.
d. If the company fail to complete the job on the date specify with the customer on the contract or otherwise agreed with the customer, the customer
may be eligible to claim a $100 per day penalty from the company until 10% of the total contract value, however, this penalty only applies to
delay incurred by mishandling and/or human error during process of job, and will not cover any cause that beyond company control.
6. Granite and marble must be generally considered in a relative sense as these materials are a product of nature and are subject to variations in colour,
shading, grain, veining and spotting therefore we cannot be responsible for such variations.
7. Disputes - If Customer disputes that any goods sold or services supplied by THE COMPANY are faulty or defective or disputes any amount payable
by it, Customer must notify its reasons in writing to THE COMPANY within 14 days following the completion date, failing which the Customer loses
any right to dispute the quality of the goods, services or quantum of.
8. In the event of any proposed cancellation of this contract, the Customer agrees to pay THE COMPANY such amounts as shall be demanded by THE
COMPANY being that company’s reasonable costs and expenses incurred to the date of such proposed cancellation, and until such payment the
Customer shall remain liable for the whole of the contract price.
9. According to the cemetery regulation, stonemason must affix their name plate to the finished monument and/or any monumental product(s) built in
the cemetery for their recording purpose.
10. All designs of monuments and accessories remain the intellectual property of THE COMPANY, THE COMPANY reserves the right for any use of
these designs, including but not limited to publishing on any advertising materials.
11. THE COMPANY reserves the final right for the interpretation of this contract.
